Search of wills and mandates

Are you looking for a will or a mandate given in anticipation of incapacity? You must have a search made in the Registers of wills and mandates of the Barreau du Québec in order to obtain a search certificate. This certificate will give you confirmation as to whether a will or mandate actually has been recorded in the Registers of wills and mandates of the Barreau du Québec. And if that is the case, you will be given the contact information of the lawyer who has that document on file in his office, and you will then be able to obtain it from that lawyer.

The Barreau du Québec does not receive any wills or mandates nor does it keep them on file. No wills or mandates are sent to the Barreau du Québec. It is the lawyers who keep them on file, in accordance with the appropriate rules. Lawyers only have the existence of these documents recorded in the Registers of wills and mandates of the Barreau du Québec.

Please note that it is important that you also contact the Chambre des notaires du Québec to have them carry out the same procedure in the Register of Notaries, in order to obtain a search certificate from that register as well.

Here are the three steps for making your search:

ONLINE Online search application

Online searches is only available for will searches. To make an online search, you must have a valid Visa or MasterCard credit card on hand as well as the original copy of the document issued by the Directeur de l’État civil and entitled "Copy of an Act of Death" or "Certificate of Death".
This document must be scanned and sent as a PDF, Jpeg or GIF file of no more than 4 MB. If the scanned file is not attached to your request, then your request won't be able to be submitted.

Make your payment:


ONLINE

By valid credit card (Visa or MasterCard) on the secure online application, in the amount of $17.25 (tax included)

BY MAIL

By valid credit card (Visa or MasterCard), by certified cheque or money order payable to the Barreau du Québec, in the amount of $23 (tax included)

Submit your request:


ONLINE

Submit your duly completed online search request, your scanned document and your payment.

BY MAIL

Send your request by mail.
Don't forget to enclose:

  • Your signed and duly completed form.
  • Your payment.
  • Your required documents, as follows:
    • For a will search: The original copy of the document issued by the Directeur de l’État civil and entitled "Copy of an Act of Death" or "Certificate of Death". We will keep the original copy.
    • For a mandate search: The original copies of a recent medical and psychosocial assessment certifying the mandator's incapacity or a recent report from the general manager of a health care or social services institution, along with an affidavit of your interest in the mandator.
If you want us to return your original copies, please enclose a photocopy (in addition to the originals).

Certificate may be sent within these waiting periods :

  • If the death or incapacity occured less than 2 weeks prior to your search request, your search certificate will be mailed within 3 weeks of the reception of your search request
  • If the death or incapacity occured more than 2 weeks prior to your search request, your search certificate will be mailed within 2 weeks of the reception of your search request
